Description
These two cases involve the same facts and crime and were tried together. Plaintiffs in error James Lock and Lawrence Lowry (hereinafter "defendants") were tried before the circuit court for Milwaukee county without a jury and were found guilty of armed robbery in violation of sec. 943.32 (1) (a), Stats. The crime was alleged to have been committed on February 27, 1964, in a tavern called Lennys Tap located on the corner of Twelfth street and North avenue in the city of Milwaukee. Lee Roy Reynolds, the victim, testified the defendants robbed him at approximately 1:30 a. m. of about $220 while he was at the bar. This was accomplished by defendants placing knives at his sides, threatening to harm him, demanding his money, knocking him to the floor, and taking the money from his pockets. Reynolds story was corroborated by his companion but denied by both defendants.
