JONES, Circuit Judge. In this appeal from the district courts order denying federal habeas corpus relief pursuant to 28 U.S.C. §Â§ 2254, appellant Lockett contends that the district court improperly denied the writ because her Ohio convictions for aggravated murder and aggravated robbery were based upon (1) improper jury instructions, (2) ineffective assistance of counsel, and (3) an improper refusal to grant a continuance. Upon consideration of the issues presented by this appeal, we conclude that the district court erred in denying habeas relief because Locketts convictions were based upon constitutionally erroneous jury instructions.
